Speed fines from a camera car in Belmont will stand, even though officials have admitted it was parked illegally.

The dark  blue Mitsubishi Outlander was photographed by cyclist ROSS KROGER in Roslyn Road, Belmont, last week.

It was parked in the dedicated bike lane and was so far from the kerb cyclists were forced to swerve into the path of traffic to avoid it.

Ross says the danger to cyclists was far greater than the threat from someone traveling slightly above the speed limit.

The Traffic Camera Office claims the operator parked the car in the dangerous position to avoid reflections, although it’s admitted the operator broke road rules.

She’s been fined $73, less than half of the scheduled fine for breaking the speed limit by less than 10 km/h.

But police are refusing to withdraw speeding fines issued by the camera, even though they were collected while the operator was performing an illegal act.

They claim the camera itself was set up within guidelines.

But that statement doesn’t line up with the speed camera operators manual, which clearly stipulates cameras must not be set up “in a way that is likely to cause any interruption to the traffic flow” or “in contravention of the Road Safety Road Rules 2009.”
