A man jailed for the murders of his three sons will appeal his life sentence, under laws introduced in Victoria in 2019.

Robert Farquharson was jailed for life, with a minimum term of 33-years, over the deaths of Jai, Tyler and Bailey.

The boys drowned after Farquharson drove his car into a dam near Winchelsea on Father’s Day, 2005, although he maintained he suffered a coughing fit while driving, causing him to black out.

He was found guilty of murder by separate juries in 2007 and 2010.

However he is launching a new bid for freedom, using Victorian laws brought in four years ago, allowing for an appeal if there is fresh and compelling evidence.

The ABC reports Farquharson’s new appeal is expected to point to the case of a truck driver jailed over a fatal crash near Shepparton.

It says the court accepted that driver had blacked out during a coughing fit.
